Augustus Cullen Law secured the final settlement of a case taken by the family of Charlotte Barry arising from negligence at the time of her birth at the National Maternity Hospital in September 2005. Charlotte suffers with severe cerebral palsy.
Proceedings were first issued in the matter in November 2007 and an interim settlement was reached in May 2010, to await the introduction of Periodic Payment Order legislation.
After nine years of waiting for the relevant legislation to be enacted, the family has reached a settlement under the recent PPO legislation, which came into force in October 2018.
Charlotte’s family has agreed an annual amount of €510,000 per annum for care until the age of 19, €535,000 per annum thereafter for the rest of her life, and a lump sum payment of €2.2 million for aids and appliances, assistive technology and various therapies. This is in addition to a total amount of almost €4.2 million, having already been awarded in compensation to date for her accommodation and care needs over the four previous sets of court proceedings.
