The Plaintiff’s original claim for damages against its insurance brokers arose following a fire which occurred in 1992 as a result of which a very substantial amount of stock owned by the Plaintiffs parent Company was destroyed.

Significant waste disposal and recovery including the recovery of hazardous waste will require a waste licence. The Waste Management Act, 1996 at Schedule 3 sets out the waste disposal activities for which a waste licence in required.

The Plaintiff in this matter was a fit and healthy woman who attended her GP following a few days of feeling unwell. Her GP wrote a referral letter to the Accident and Emergency Department of a large South Dublin Hospital which stated that she was suffering from suspected appendicitis.
The Deceased was a fit and healthy 31 year old man who attended the Accident & Emergency Department of a large Dublin Hospital complaining of acute pain in his upper abdomen and left chest following an incident at his place of employment.

In February 2010 the President of the High Court, Mr Justice Nicholas Kearns, established a working group to look into the desirability of recommending reforms to the law in relation to the manner by which damages in personal injury claims are awarded. The high powered expert working group have been looking at reforming the current system of payment of lump sum damages.

Augustus Cullen Law successfully appealed to the High Court on behalf of an infant with Cerebral Palsy to secure release of a transcript of evidence given before the Fitness To Practice Committee of the Medical Council. This vital new factual evidence, concerning the Plaintiff’s labour and delivery (from midwives and doctors who were present), thus became available to the Plaintiff and was crucial to the issue of the Defendant’s negligence.
