Augustus Cullen Law last week were successful in winning substantial damages for a 65 year old Galway woman. The facts were that the Plaintiff attended University College Hospital, Galway for a series of mammograms from 1993 onwards. On each visit, she was assured that the scans were normal and on each occasion was advised to return in 2 years.

The recent enactment of the Medical Practitioners Act, 2007 has been heralded as a major change to the manner in which the Medical profession is to be regulated. The 2007 Act now requires professional misconduct enquires to be heard in public, unless at the request of either the medical practitioner or the patient, the Fitness To Practice Committee decides otherwise in the “interests of Justice”.

The Plaintiff’s original claim for damages against its insurance brokers arose following a fire which occurred in 1992 as a result of which a very substantial amount of stock owned by the Plaintiffs parent Company was destroyed.
