David Lavelle, former Managing Partner at Augustus Cullen Law, has announced that Michael Boylan, Head of the firm’s Medical Negligence Group, will succeed him as the newly elected Managing Partner in the firm.

On 1 February 2013 Ms Justice Irvine delivered her Judgment in the case following a lengthy 45 day Trial taken on behalf of a child (now 10 years old) who sustained catastrophic brain damage resulting in Dyskinetic Cerebral Palsy by reason of the failure of the nursing and paediatric staff to ensure that he was adequately resuscitated during the first 23 minutes of his life.
I am personally delighted with this verdict and that Eoin and his parents have gotten justice and will now receive appropriate compensation to make life a bit easier for them. This case was one of the most complex and hard fought birth injury cases this firm has ever handled.

The Plaintiff, who was only 24 at the time, attended her General Practitioner in 2005 complaining of lumps and pain/tenderness in her left breast. Her GP referred her to the local Breast Clinic at the Regional Hospital where the staff carried out a physical examination of the Plaintiff, but did not carry out an ultrasound or biopsy.
The minor Plaintiff was born at a regional maternity hospital in 2002. His delivery was complicated by shoulder dystocia - a condition involving the impaction of the child’s shoulder on the mother’s symphsis pubis as he descended the birth canal. Management of this occurrence should involve the performance of the McRoberts’ manoeuvre together with the application of supra-pubic pressure in an effort to release the impacted shoulder.
The Plaintiff attended a private Consultant Gastroenterologist, the first named Defendant at a private hospital in Dublin, the second named Defendant, having been referred by his General Practitioner for a colonoscopy. The procedure was carried out and the Plaintiff discharged later the same day. He went on to develop severe abdominal pain and attended his local out of hours GP service who referred him to his local general hospital emergency department with a queried suspected bowel perforation.
