The Plaintiff’s medical negligence claim arose following the administration of excessive morphine (27 times the prescribed dosage) during an emergency caesarean section. As a consequence of the morphine overdose, she suffered from a short period of depressed respiration as well as slurred speech and confusion.
The Plaintiff’s medical negligence claim relates to a dental procedure carried out in December 2004. The Plaintiff presented at the dentist’s surgery with a bifurcation fracture of her LL6 tooth.

The Plaintiff’s claim in this case was for damages for personal injuries caused as a consequence of negligent and inadequate orthodontic treatment over a period of 5 years.
With the downturn in the economy, there has been an increase in professional negligence cases against Solicitors, particularly in relation to property transactions. However, there is now an increasing propensity for the Courts to strike out litigation cases for delay or want of prosecution. This will naturally lead to an increase in professional negligence actions taken against Solicitors in litigation matters where cases have been struck out for delay and want of prosecution.

The recent case of the HSE –v- LG and JJ  IEHC 297 displayed the view of the High Court of applications made to it to request the Courts of another Member State to assume jurisdiction in care proceedings. The application in this case related to a child who was born in Ireland of English parents and was the subject of care proceedings here.
The very sensitive nature of child care proceedings leads to little surprise that proceedings are invariably held in camera with strict reporting limits. Recent times have seen the introduction of The Child Care Law Reporting Project. While reporting on cases that occur from day to day in the Child Care list in the High Court and the District Court, proceedings remain in camera.
