On 8th December 2016, Mr. Justice Cross of the High Court approved a settlement achieved by Augustus Cullen Law on behalf of a Plaintiff who suffered severe injuries in a road traffic accident in 1998 when she was 9 years old. Augustus Cullen Law were instructed by the Plaintiff in 2012.
The Plaintiff suffered significant life changing injuries as a result of the accident. In addition to a range of physical injuries, the Plaintiff suffered a fracture at the base of her skull and a traumatic brain injury. The Plaintiff has required and will require into the future extensive care in terms of Occupational Therapy, Physiotherapy, Speech & Language Therapy, Neuropsychological Treatment and Nursing Care. This care and treatment will be required for the remainder of her life.
Liability was not admitted by the Defendants and if the case ran to a full hearing, there was a danger that the Plaintiff could have lost her claim or had a significant amount of her award deducted due to contributory negligence in circumstances where she has no memory of the accident and the only two other witnesses were 9 years old at the time.
The settlement achieved was based on 75% of what Augustus Cullen Law’s legal team had calculated the full value of the claim to be. Previous offers made by the Defendants had been rejected and it was only on the day of the hearing when a Judge had been assigned when an offer was made that our legal team agreed to put to the Court.
Mr. Justice Cross on hearing the application from Augustus Cullen Law’s legal team, stressed that he believed that this was an excellent settlement for the Plaintiff and so approved the sum of €6.75 million together with an Order for the Plaintiff’s legal costs.
