SI No.666 of 2006 – EU Energy Performance of Buildings Regulations of 2006
A recent update for Property Law is that all new houses and apartments offered for sale or being rented must have an* Energy Rating Certificate*, called a BER Certificate, where Planning Permission was applied for on or after the 1st of January 2007.
Where Planning Permission was applied for prior to the 31st of December 2006, all new houses and apartments are required to have BER Certificates when offered for sale or renting unless substantial works have been completed by the 30th of June 2008. In relation to commercial property, any new commercial property offered for sale or to let which was built pursuant to a planning application applied for on or after the 1st of July 2008 must have a BER Certificate, unless substantial works have been completed by the 30th of June 2010 (except when such buildings offered for a second or subsequent sale or letting).
All existing residential and commercial property offered for sale or renting on or after the 1st of January 2009 must have a BER Certificate.
Please note that any person who contravenes any requirement of the Regulations commits an offence which can be punishable by fine on summary conviction, not exceeding €5,000.
