Darragh was born in June 2005 at the Mid-Western Regional Maternity Hospital Limerick and went on to develop spastic quadriplegic cerebral palsy following the mismanagement of his birth during the course of which suffered a chronic partial hypoxic injury to his brain. Liability for his injuries was admitted in 2013 by the Health Service Executive and following a mediation meeting in May 2013, an interim settlement of €2,158,541 was agreed and the case adjourned for a period of two years to allow for the introduction of periodic payment legislation.
The long promised legislation has still to materialise and Darragh’s parents agreed to a further interim payment in May 2015 to cover Darragh’s needs for the next 4 years during which time it is hoped the legislation will be introduced by the government. An interim award of €1,625,000 and costs was agreed at a settlement meeting shortly before the case was due back before the Court and will ensure that Darragh’s complex care needs are met during the period before the case comes back before the Courts for a third time.
