Augustus Cullen Law recently settled a case on behalf of a Plaintiff who suffered injuries during a dental procedure. The Plaintiff had attended with a General Dental Practitioner for a routine dental procedure. As a result of the substandard treatment received, the Plaintiff suffered an ora-antral fistula which was not recognised or treated immediately by the Defendant thereby necessitating a more difficult and significant operative procedure to be carried out by a Consultant Oral Surgeon. Thereafter, the Plaintiff developed significant pain in this region of his mouth which established a chronic pain picture which has not resolved and will continue into the future despite the Plaintiff’s attendance for treatment with a Consultant Anaesthetist and Pain Specialist.
The Plaintiff contacted Augustus Cullen Law who obtained expert independent reports from an expert Dental Surgeon and an expert General Dental Practitioner in the UK. Both of the aforementioned experts were critical of the Defendant and in particular in relation to the failure to take pre-extraction radiographs, the Defendant Dentist’s failure to stop the extraction when it was difficult and thereafter his attempt to remove the root of the tooth blindly by excavating deep into the depths of the root socket.
A full Defence was entered by the Defendants in March 2014 fully traversing the Plaintiff’s claim by denying each and every particular of negligence as pleaded. Further the Defendants also denied that the Plaintiff suffered the alleged or any personal injury at all. The negligence issue in this case was extremely complex as was the causation issue. Augustus Cullen Law maintained a strong stance throughout and this case was listed for Hearing on the 9th of May 2017. However, the case settled for the sum of €80,000 plus legal costs one week before the Hearing was to begin.
